- The U.S. Equal Employment Opportunity Commission opened its 2022 EEO-1 Component 1 data collection Oct. 31. Reports must be submitted by Dec. 5, the agency said in a news release.
- The EEO-1 Component 1 report is a mandatory demographic data report the EEOC requires from all private-sector employers with 100 or more employees, and from certain federal contractors.
- EEOC’s Office of Enterprise Data and Analytics released a booklet to help filers complete the process. It has also provided a Filer Support Team Message Center and other resources, the agency said.

After initially projecting a mid-July time frame for data collection, EEOC pushed back the process — a common occurrence in recent years.
The data collection requires employers to submit information by job category as well as sex and race or ethnicity. The agency has faced some criticism in the past for not providing a reporting option for nonbinary employees, which may put HR pros in a difficult position. EEOC addressed how to approach this oversight extensively in its instruction booklet.
“Employers may voluntarily choose to report employee demographic data for non-binary employees … in the ‘comments’ section of the report(s),” the agency wrote. “Employers that voluntarily choose to report non-binary employees in the ‘comments’ section of the report(s) should not assign such employees to the male or female categories or any other categories (i.e., job category and race or ethnicity) within the report(s).”
In addition to the EEO-1 Component 1 report, the EEO-4 data collection for state and local government workforce demographic data also opened Oct. 31, also with a deadline of Dec. 5. The EEO-4 collects similar data, as well as salary band information, and comes with its own instructional booklet.
EEOC will publish any updates related to the EEO-1 process to the dedicated website, the agency said.
